The website www.mykindabook.com (“Site”) is owned and operated by Pan Macmillan Limited ("Macmillan") and the information and materials appearing on the Site ("the Content") are displayed for personal, non-commercial use only. All software used on this Site and all Content included on this Site (including without limitation Site design, text, graphics, audio and video and the selection and arrangement thereof) is the property of Macmillan or its suppliers and is protected by international copyright laws.

None of the Content may be downloaded, copied, reproduced, republished, posted, transmitted, stored, sold or distributed without the prior written permission of the copyright holder. Modification of any of the Content or use of any of the Content for any purpose other than as set out herein (including without limitation on any other website or computer network) is prohibited. 2. Links to third party web sites

The Site may include links to third party Internet websites which are controlled and maintained by others. These links are included solely for the convenience of users and do not constitute any endorsement by Macmillan of the websites linked or referred to, nor does Macmillan have any control over the content of any such websites. It is for you to make your own judgement about third party websites.

You should direct any concern about any other website to that website’s administrator or web master.

3. Registration

If you are thirteen or under: You should obtain your parent’s or guardian’s permission before registering with this Site.

Only one registration per person is allowed. You must keep your registration information up to date.

You must choose a personal email address which gives you frequent access to emails sent to that address, as we need to be able to contact you. You must keep your password confidential.

You must not:

  1. impersonate or try to impersonate another person;
  2. disclose your password to anyone else;
  3. allow anyone else use to your account;
  4. use anyone else's account.

You are responsible for everything done using your account, even if someone else is using your registration details without your knowledge. We want to protect the privacy of visitors to this Site and that of our customers and other individuals.  Please read our Privacy Policy it will help you to understand how we use your personal data. Whenever you give us personal data, you are consenting to its collection and use in accordance with our Privacy Policy.

6. Changes to these Terms and Conditions

Macmillan reserves the right to add to or change these terms and conditions. Any changes will be posted to this page and it is your responsibility as a user to ensure that you are aware of any such changes from time to time. Changes will become effective 24 hours after first posting and you will be deemed to have accepted any change if you continue to access the Site after that time.

7. User information

Macmillan collects information on what pages are accessed or visited by consumers, as well as information volunteered by the consumer, such as survey information and/or website registrations. Macmillan uses this information for internal review, in order to improve the Content of the Site and to notify consumers about updates to the Site.

8. Posting Content

Macmillan does not vet and is not responsible for any information which is posted in the Mykindabook Blog or in any other area on the Site (together known as the "Public Areas"). Any content, recommendation or other information within the Public Areas is viewed and used by you at your own risk and Macmillan does not warrant, in any respect, the accuracy or reliability of any of the information posted in the Public Areas. The views expressed in the Public Areas are those of the individuals and are not necessarily those of Macmillan.

Macmillan does not moderate content before it is posted but retains the right to delete, move, edit, update or otherwise alter content in any way, at our discretion and without notice.

By posting your comments or materials on the Public Areas, you grant us a non-exclusive, perpetual, royalty-free, world-wide licence to use, reproduce, modify, adapt, translate, publish, distribute and display any content you submit to us in any format now known or later developed. If you do not want to grant us these rights, please do not submit your comments or materials to us.

You may use the Public Areas only to post content that is proper and appropriate to such areas and you must not do any of the following:

  • act in breach of these Terms and Conditions / or our Privacy Policy.

Macmillan shall be entitled at any time to delete, remove, or suspend the whole or any part of the Public Areas or any content posted on them without notice and without incurring any liability. If you find objectionable or offensive material in the Public Areas please let us know as soon as possible by emailing Mykindabook@macmillan.co.uk.

9. Maintenance of the Site

Making your use of the Site enjoyable means we need to fix bugs, install updates and do general diagnosis and maintenance of the Site. We will try to do scheduled maintenance during times when we anticipate that online use is lower than normal. We also need to be able to do emergency maintenance and/or suspend access to the servers where, in our reasonable discretion, we see the need to do that. We will try to have the Site available again as soon as we think it is safe to do so.

10. Validity of these Terms

If any part or provision of these Terms is found to be unlawful or unenforceable, this shall not affect the validity of any other part or provision.

11. Jurisdiction and applicable law

These Terms and Conditions are governed by English law. The English courts shall have exclusive jurisdiction.
